What is an easement?
An easement is an area of land registered on your property title which gives another party the right to use the land for a specific purpose, even though they are not the landowners. Councils and authorities may access an easement to maintain, install, replace or upgrade essential service structures such as pipes, drains and cables. If you have an easement on your property it will be clearly marked on the certificate of title.
What restrictions are placed around easements?
As your local council will need to access the easement from time to time, accessibility must be considered when planning a new build. Building over essential infrastructure such as drains and sewerage systems will not only prevent contractors from accessing the site, it can also be dangerous. If you are building within a metre of an easement, prior approval must be granted by the local council.
